1. Who this is for
This notice is for people in the United States, and in particular for residents of Washington (My Health My Data Act), Nevada (SB 370) and Connecticut, whose laws give consumer health data its own protection. It adds to the Privacy Policy, which describes everything else Wakify does with personal data. Where this notice gives you more rights than the Privacy Policy, this notice applies.
Wakify is published by Mats Hoogerwerf, trading as Core Creatives, Nieuwstraat 87, 3311 XR Dordrecht, the Netherlands. Email info@core-creatives.com.
2. The consumer health data Wakify collects, and why
"Consumer health data" is personal information that identifies your past, present or future physical or mental health. For Wakify, that is the following. We process each item only for the purpose shown, and never for advertising.
| Category | What it is | What we use it for |
|---|---|---|
| Sleep sessions | When a tracked night started and ended, the estimated sleep stages, the sleep score, how many sounds such as snoring were detected and when, and where the stages came from | To show you your sleep history and trends, and to restore them on a new phone. Stored in your account only after you agree on a separate consent screen |
| Night tags | The tags you choose to add to a night, including "Sick" and "Stress" | To show you what may affect your sleep. Stored with the night, under the same consent |
| Night sound | The microphone signal during a tracked night, and the short clips you can play back | Analysed on your phone to estimate your sleep. Never sent to us or anyone else. Clips stay on your phone for as long as you choose |
| Motion during a tracked night | Movement of the phone | Analysed on your phone to estimate your sleep. Never sent to us |
| Apple Health sleep and heart data | Sleep analysis, heart rate and heart rate variability that other apps and devices wrote into Apple Health | Read on your phone, only if you allow it, to import nights and estimate their stages. Heart data is never sent to us; only the resulting sleep summary is stored, under the consent above |
| Answers about your sleep habits | Your usual bedtime and wake time, how often you snooze or fall back asleep, and whether you feel groggy in the morning, from the questions during setup | To set up your first alarm and personalise the App |
| Mission choice | Which mission an alarm uses. Choosing the Pills mission may suggest that you take pills or vitamins | To run the alarm, count your streak and measure whether the alarm works. Photos taken in a mission are checked on your phone and never saved or sent |
We do not collect precise location, biometric identifiers, or information about seeking health care services, and we do not use any of the data above to infer a health condition.
3. Where it comes from
- From you, when you track a night, add a tag or answer a question during setup.
- From your phone's sensors, the microphone and motion sensor, processed on your phone.
- From Apple Health, only if you give Wakify permission in Apple's own permission sheet.
4. Who we share it with
We do not sell consumer health data, and we do not share it for advertising. Nobody else using Wakify can see any of it: the leaderboard and public profiles never include sleep data.
The only parties that receive consumer health data are:
| Category of recipient | Who | What they receive, and why |
|---|---|---|
| Our hosting and database provider, acting only on our instructions | Supabase Inc. (servers in Frankfurt, Germany); supabase.com/privacy | The sleep sessions, night tags and setup answers in section 2, to store your account |
| Our product analytics provider, only if you turn analytics on, acting only on our instructions | PostHog, Inc. (PostHog Cloud EU, Frankfurt); posthog.com/privacy | Which mission type an alarm used, which can include the Pills mission. Never your sleep score, sleep stages, tags or any Apple Health data |
| Apple Health on your own phone, only if you switch it on | Apple Inc.; apple.com/legal/privacy | The time you were in bed and asleep for nights Wakify tracked, written to your own Health app at your request |
We may also disclose data where the law requires it, for example to comply with a valid court order. We have no affiliates.
5. Consent
We collect and store sleep data in your account only after you agree on a separate consent screen, shown the first time you track a night or import from Apple Health. It is not part of accepting the Terms of Use. Reading Apple Health data needs, in addition, your permission in Apple's own sheet. We do not share consumer health data beyond section 4, so we do not ask for consent to share it; if that ever changed, we would ask for that consent separately first.
You can withdraw consent at any time: in Wakify, Settings, then Preferences, switch off sleep storage or the Apple Health switches, or revoke Wakify's access in the Health app. Withdrawing stops new collection. Deleting the stored nights, or your account, removes what was collected.
6. Your rights, and how to use them
You have the right to:
- confirm whether we collect or share your consumer health data;
- access that data, and receive a list of every third party it was shared with, with their contact details (section 4 is that list today);
- withdraw your consent (section 5);
- delete that data. When we delete it we also delete it from our providers' systems, and residual copies in encrypted backups expire within 30 days.
How. Delete everything at once in the App under Settings, then Delete Account, or export your data under Settings, then Preferences, then Export my data. For anything else, email info@core-creatives.com with "Consumer health data request" in the subject. We may ask you to confirm the email address on your account so that we do not give your data to someone else. We answer within 45 days, and if we need up to 45 more days for a complex request we will tell you why within the first 45. Requests are free.
Appeals. If we decline your request, in whole or in part, you can appeal by replying to our answer with "Appeal" in the subject within 60 days. Someone who did not make the first decision will look at it, and we will tell you the outcome and the reasons within 45 days. If we deny the appeal, you can contact the attorney general of your state: Washington at atg.wa.gov, Nevada at ag.nv.gov, or Connecticut at portal.ct.gov/ag.
We will not treat you differently, charge you more or give you a worse service because you used any of these rights.
7. What we never do
- We never sell consumer health data, and we never share it for advertising.
- We never set up a geofence around a place where health care is provided.
- We never use consumer health data to decide what anyone else sees about you.
8. Changes
If we change what consumer health data we collect or who receives it, we will update this notice first, change the date at the top, and tell you in the App before the change takes effect. If a change needs your consent under the laws above, we will ask for it.
